Nursing Home Abuse

Each year thousands of senior citizens are abused and neglected in nursing homes and elder care facilities. Many of these victims are frail and vulnerable and unable to help themselves. As a result, they are left to depend on others to meet their most basic needs.

The State of California enacted The Adult Civil Protection Act to give extra protection to elders. Nursing home abuse falls into two categories, neglect and intentional harm.

  • Neglect: Neglect includes the failure to provide for basic needs which can result in dehydration, malnutrition, medication overdoses, missed medication, falls, infections and bedsores.

  • Intentional Harm: Intentional harm includes physical attacks, sexual abuses, emotional abuse financial abuse.

Nursing homes are required to care for their residents in such a manner that it will promote proper maintenance and enhancement of the quality of life of each resident and provide services and activities to maintain the highest practicable physical and mental well-being of each resident. In order to accomplish this, there must also be a written plan of care. The plan must specifically describe the medical and nursing needs of the resident.
