WHO WILL CARE FOR MY MINOR CHILDREN?

All parents worry about what happens to their minor children if both parents die before their children turn 18.  This concern draws many people to lawyer's offices to start the estate planning process.

If one parent dies or becomes incapacitated, then usually the surviving parent will retain sole custody of any minor children. If both parents die, then usually there must be a Court action to appoint a legal guardian for the children.  With a properly drawn Trust, you can designate who you would like to be appointed as the Guardian for your children and greatly streamline the process of having a Guardian appointed.  Additionally, you get to choose who becomes Guardians of your children in a time when your children will need comfort and security.
